Are my kids candidates for dual citizenship?

Today, Karen had a question regarding dual citizenship for her future children.

Here is Karen’s e-mail:

I am not yet a US citizen but a green card holder. I am married to a US citizen. We are planning for a baby next year and maybe another one a year after. I am planning to apply for US citizenship through naturalization after that. I know I will be qualified for dual citizenship since I was born in the Philippines. My question is, will our soon to be children (born before my US naturalization) be a candidate for dual citizenship?

Hello Karen,

Karen will be naturalized in the USA

Karen will be naturalized in the USA

You really have no worries on this.  Actually, you have a couple of different paths to Philippine Citizenship for your children.

First, if you have your children while you are still a Philippine Citizen, or after you have already filed for and received Philippine Dual Citizenship, then your kids will automatically become Philippine citizens at the time of their birth, because they were born to a Philippine Citizen mother.  Of course, they will also be a US Citizen since they will be (I assume) born in the USA.  Just one thing you need to do.  When your children are born, you need to file a report of birth abroad with the Philippine Consulate nearest to where you live.

Secondly, if you have your children while you are a US Citizen, and have not yet applied for Dual Citizenship, your children can be included in your Dual Citizenship application, thus gaining their dual citizenship that way.

Good luck to you Karen.  Everything is in hand, you just need to follow a few simple steps.

Take care.
